Services Business Succession Agreement

Business Succession Agreement

This is a legal agreement and the document is admissible in court. The document is governed by Western Australian law.

The Business Succession Agreement ( BSA ) contains all immediate exit strategy and business valuation decisions and rules agreed by clients and recorded in their succession report.  The BSA also acts as a bsashareholders agreement with complete corporate governance and dispute resolution procedures. Typically the BSA will take precedence over existing business share and partnership agreements.

My consultancy experience shows significant cost and time saving to my clients when their agreements are drafted by those specialist taxation and estate planning solicitors I recommend.

This is because the agreement is underpinned on recommendations in the business succession report ( BSR ) that has been developed by me and will be unfamiliar to solicitors who have not worked with me previously.

Typically, BizSuccession Solutions will obtain a firm quote for client acceptance before solicitors are engaged by me, acting as your agent.

This ensures you are not surprised by legal costs.

Alternatively, as my client you may choose to use any solicitors you are comfortable with. When working with your solicitor the matter of costs will be based on your existing relationship and the final agreement will vary to the depth and degree of their experience, and understanding of my BSR.

Julie Says

We are in a syndicate raised by us to purchase a commercial winery. Our accountant was concerned about potential withdrawal of capital and the effect this would have on our bank and remaining backers. Jim was asked to come in, sort it out and get written agreement from all parties as to the movement of capital. He delivered everything we needed and more. Every syndicate member was relaxed and so were our bankers. The legal side was set up by a solicitor of Jims suggestion and it was the simplest set of actions for us all to achieve security of investment.
